This clarification text has been prepared by Neh İnşaat Turizm ve Otelcilik Ulaşım Tic. A.Ş. (
‘’Sunlight Hotel’’) acting in the capacity of data controller, within the framework of Article
10 of the Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the
Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation, in order to
inform you about the purposes of processing your personal data, legal reasons, collection
method, to whom it can be transferred and your rights under the KVKK.

A total of 28 security cameras are installed on the exterior of our service area, in the corridors
of the building, on the terrace, in the café and in the lobby to ensure the security of our service
area, and the recording process is supervised by administrative affairs.
Your personal data in question is processed by automatic means based on the legal reason
“data processing is mandatory for the legitimate interests of the data controller, provided that
it does not harm the fundamental rights and freedoms of the data subject” in Article 5 of the
Law. In addition, your personal data may be transferred to judicial authorities or relevant law
enforcement agencies upon request to resolve legal disputes or in accordance with the relevant
legislation.
Article 20 of the Constitution stipulates that everyone has the right to be informed about
personal data concerning him/her. Article 11 of the LPPD lists the rights of the personal data
subject under the law.
You may submit your requests within the scope of Article 11 of the Law regulating the rights
of the data subject, according to Article 5 of the “Communiqué on the Procedures and

İşbu aydınlatma metni, veri sorumlusu sıfatıyla hareket eden Neh İnşaat Turizm ve Otelcilik
Ulaşım Tic. A.Ş. ( ‘’Sunlight Hotel’’) tarafından, 6698 sayılı Kişisel Verilerin Korunması
Kanununun (“KVKK”) 10. maddesi ile Aydınlatma Yükümlülüğünün Yerine Getirilmesinde

Hizmet sahamızın dış cephesinde, bina koridorlarında, terasta, kafede ve lobide olmak üzere
toplam 28 adet güvenlik kamerası vasıtasıyla ve hizmet sahamızın güvenliğinin sağlanması
amacıyla görüntü kaydı yapılmakta ve kayıt işlemi idari işler tarafından denetlenmektedir.
Söz konusu kişisel verileriniz, Kanunun 5. maddesinde yer alan “ilgili kişinin temel hak ve
özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri
işlenmesinin zorunlu olması” hukuki sebebine dayanarak otomatik yollarla işlenmektedir.
Ayrıca ilgili kişisel verileriniz hukuki uyuşmazlıkların giderilmesi veya ilgili mevzuatı gereği
talep halinde adli makamlar veya ilgili kolluk kuvvetlerine aktarılabilecektir.
Anayasa’nın 20. maddesinde herkesin, kendisiyle ilgili kişisel veriler hakkında bilgilendirilme
hakkına sahip olduğu ortaya konulmuştur. KVKK’nın 11. maddesinde kişisel veri sahibinin
kanun kapsamındaki hakları sayılmıştır.
Kanunun ilgili kişinin haklarını düzenleyen 11. Maddesi kapsamındaki taleplerinizi, “Veri

natural person suppliers or legal person supplier representativeswill be processed for the
following purposes.

2) What are the Collection Methods of Your Personal Data?
Your personal data mentioned above in categories are gathered in automatedor non-
automated ways through physical means such as order forms, contracts, visitor forms, or
information systems and electronic devices (e.g. telecommunications infrastructure,
computers and phones), third parties (e.g. KKB and Findeks Report), our website and other
documents declared by the person concerned.
3) What Is the Legal Reason For Collecting Your Personal Data?
Your personal data is processed by Neh İnşaat Turizm ve Otelcilik Ulaşım Ticaret Anonim
Şirketi (“Sunlight Hotel ”) in order to achieve the objectives described above, it is processed
based on the following legal reasons stated in Article 5 of KVKK;
(i) Clearly prescribed by law

(ii) Provided that it is directly related to the establishment or execution of a
contract, the processing of personal data of the parties necessary to the
contract
(iii) Data processing is mandatory for the data controller to fulfiltheir legal
obligation
(iv) Data processing is mandatory for the establishment in order to exercise
orprotecta right
(v) Data processing is mandatory for the legitimate interests of the data
controller, provided it does not harm the fundamental rights and freedoms of
the person concerned.
When the data processing activity cannot be based on one of the above legal reasons, your
personal data is processed based on your explicit consent.
4) Do We Transfer Your Personal Data to a Third Party?
a)Personal data belonging to our visitors if required by the relevant legislation can be
shared with law enforcement and judicial authorities for the purpose of resolving legal
disputes.
b) Personal data of our online visitors if required by the relevant legislation can be shared
with judicial authorities and authorized public institutions and organizations for the purpose
of resolving legal disputes.
c) Personal data belonging to our customers, within the scope stipulated by legal
regulations, it is transferred to authorized public institutions and organizations, our financial
advisor and cargo company in order to carry out the activities in accordance with the
legislation, to follow and carry out legal affairs, to inform authorized persons, institutions and
organizations. In addition, such personal data may be transferred to the law firm and judicial
authorities from which we receive services in order to be used as evidence in legal disputes
that may arise in the future.
d)The personal data of our potential customers can be transferred to the law firm and
judicial authorities in which we receive service in order to be used as evidence in future legal
disputes.
e) Personal data belonging to our supplier employees are transferred to authorized public
institutions and organizations; cargo companies and financial advisors for the purposes of
conducting activities in accordance with the legislation, following and conducting legal
affairs, informing authorized persons, institutions and organizations, and conducting /
auditing business activities within the scope stipulated by the legal regulation. In addition,
such personal data may be transferred to the law firm and judicial authorities from which we
receive services in order to be used as evidence in legal disputes that may arise in the future.

f) The personal data belonging to our supplier official are transferred to authorized public
institutions and organizations, companies, banks and our financial advisor in order to carry
out the activities in accordance with the legislation, to follow and carry out legal affairs, to
provide information to authorized persons, institutions and organizations, and to carry out /
supervise business activities within the scope stipulated by legal regulations. In addition, such
personal data may be transferred to the law firm and judicial authorities from which we
receive services in order to be used as evidence in legal disputes that may arise in the future.

Kişisel verileriniz, Neh İnşaat Turizm ve Otelcilik Ulaşım Ticaret Anonim Şirketi (“Sunlight

cards necessary in order to make accommodation.
The personal data you share through the stay limited to identification information (name,
surname, TC identification number, passport number, name, surname and TC identification
number of the people staying with you, birthdate, identification type, date and number,
occupation, permanent address), contact information (e.g., phone number, address, e-mail
address,) necessary information in order to make payment (credit card information) and
company information data are processed in order to fulfil the legal obligations of the data
controller and establish your hotel accommodation.
The personal data you will share in question must be accurate and up to date in line with the
principles of; Pursuant to paragraph (1) of Article 4 of the KVKK, “a) To comply with the law
and the rule of honesty b) To be correct and up-to-date when necessary c) To be processed for
specific, explicit and legitimate purposes ç) To be associable, limited and proportional for the
purpose of processing d) to be kept for the period stipulated in the relevant legislation or
required for the purpose for which they are processed” The data subject is responsible for any
disputes that may arise from the processing of incorrect and outdated personal data.The

Law No. 6698 on the Protection of Personal Data (“LPPD”) grants personal data owners
(“Applicant”), who are defined as data subjects, the right to make certain requests regarding
the processing of their personal data in accordance with Article 11 of the LPPD.
The application form has been prepared in order to determine your relationship with Sulhan
Neh İnşaat Turizm ve Otelcilik Ulaşım Ticaret Anonim Şirketi ( ‘’Sunlight Hotel’’) to
determine your personal data processed by Sunlight Hotel, if any, and to respond to your
application accurately and within the legal period. In order to ensure the security of your
personal data and to prevent unlawful data transfer, additional information may be requested
by Sunlight Hotel for identification and authorization. In the event that the information
specified by the Applicant is not correct and / or up-to-date or the requests are unauthorized,
the Applicant is responsible for this matter.
Pursuant to Article 7 of the Communiqué on the Procedures and Principles of Application to
the Data Controller, if the Applicant’s application is to be answered in writing, no fee is
charged up to ten pages. A transaction fee of 1 Turkish Lira may be charged for each page
over ten pages. If the response to the application is given in a recording medium such as CD,
flash memory, etc., a fee may be charged up to the cost of the recording medium.
2. Scope of the Right to Apply under Article 11 of the LPPD
The Applicant may apply to Sunlight Hotel Company and request the following:
1) Learn whether their personal data is being processed,
2) Request information if their personal data has been processed,
3) To learn the purpose of processing personal data and whether they are used in accordance
with their purpose,
4) To learn the third parties to whom personal data are transferred domestically or abroad,
5) To request correction of personal data in case of incomplete or incorrect processing and to
request notification of the transaction made within this scope to third parties to whom
personal data is transferred,
6) Although it has been processed in accordance with the provisions of the KVKK and other
relevant laws, to request the deletion, destruction or anonymization of personal data in the

6698 Sayılı Kişisel Verilerin Korunması Kanunu’nda (“KVKK”) ilgili kişi olarak tanımlanan
kişisel veri sahiplerine (“Başvuru Sahibi”) KVKK’nın 11. maddesi uyarınca kişisel verilerinin
işlenmesine ilişkin birtakım taleplerde bulunma hakkı tanınmıştır.
Başvuru formu, Neh İnşaat Turizm ve Otelcilik Ulaşım Ticaret Anonim Şirketi (‘’Sunlight
Hotel”) ile olan ilişkinizi tespit ederek, varsa, Sunlight Hotel tarafından işlenen kişisel
verilerinizin eksiksiz olarak belirlenerek, ilgili başvurunuza doğru ve kanuni süresinde cevap
verilebilmesi için hazırlanmıştır. Kişisel verilerinizin güvenliğinin sağlanması ve hukuka
aykırı veri aktarımının önlenmesi amacıyla, kimlik ve yetki tespiti Sunlight Hotel tarafından
ek bilgiler istenebilir. Başvuru Sahibi tarafından belirtilen bilgilerin doğru ve/veya güncel
olmaması ya da taleplerin yetkisiz olması halinde, bu hususa ilişkin sorumluluk Başvuru
Sahibi’nindir.
Veri Sorumlusuna Başvuru Usul Ve Esasları Hakkında Tebliğ’in 7. maddesi uyarınca
Başvuru Sahibi’nin başvurusuna yazılı olarak cevap verilecekse, on sayfaya kadar ücret
alınmaz. On sayfanın üzerindeki her sayfa için 1 Türk Lirası işlem ücreti alınabilir. Başvuruya
cevabın CD, flash bellek gibi bir kayıt ortamında verilmesi halinde kayıt ortamının maliyeti
kadar ücret talep edilebilir.
2. KVKK’nın 11. Maddesi Çerçevesinde Başvuru Hakkının Kapsamı
Başvuru Sahibi Sunlight Hotel’e başvurarak aşağıda yer alan konularda talepte bulunabilir:
1) Kişisel verilerinin işlenip işlenmediğini öğrenme,
2) Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
3) Kişisel verilerinin işlenme amacı ve bunların amacına uygun kullanılıp kullanılmadığını
öğrenme,
4) Kişisel verilerinin yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri öğrenme,
5) Kişisel verilerinin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme
ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini
isteme,
6) KVKK ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen,
işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerinin silinmesini, yok
edilmesini veya anonim hale getirilmesini isteme ve bu kapsamda yapılan işlemin kişisel
verilerinin aktarıldığı üçüncü kişilere bildirilmesini isteme,
7) İşlenen verilerinin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle
aleyhine bir sonucun ortaya çıkmasına itiraz etme,
8) Kişisel verilerinin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın
giderilmesini talep etme.

KVKK’nın 13. maddesinin birinci fıkrası uyarınca; bu haklara ilişkin olarak yapılacak
başvuruların yazılı ve imzalı olarak veya Kişisel Verilerin Korunması Kurulu (“Kurul”)
tarafından belirlenen diğer yöntemlerle tarafımıza iletilmesi gerekmektedir.
Bu çerçevede yazılı olarak yapılacak başvurular, işbu formun çıktısı alınarak;
Başvuru Sahibinin şahsen elden başvurusu ile,
Noter vasıtasıyla,
Kayıtlı elektronik posta (KEP) adresi, güvenli elektronik imza, mobil imza ile veya
Başvuru Sahibinin tarafımıza daha önce bildirdiği ve sistemimizde kayıtlı bulunan
elektronik posta adresinden göndereceği e-mail ile tarafımıza iletilebilecektir.
Aşağıda, yazılı başvuruların ne şekilde tarafımıza ulaştırılacağına ilişkin yazılı başvuru
kanalları özelinde bilgiler verilmektedir.
